Privacy Policy

This Privacy Policy describes the privacy practices of Vitruvy.com (“Vitruvy”, “we,” “us,” “our”). This Policy applies to our website visitors, consumers, business associates, agents and other individuals who interact with us.  

Capitalized terms not otherwise defined in this Privacy Policy have the same meaning as set forth in the Vitruvy Terms and Conditions (“Terms and Conditions”). 

By creating, registering, or logging into an account through the Service, or otherwise accessing or using the Service, you are acknowledging the most recent version of this Privacy Policy. If we make any changes to our Privacy Policy, we will post the revised Privacy Policy and update the “Last updated” date of the Privacy Policy. 

If you are using the Service on behalf of an individual other than yourself, you represent that you are authorized by such individual to act on such individual’s behalf and that such individual acknowledges the practices and policies outlined in this Privacy Policy. 

1. Personal information we collect. Vitruvy collects certain personally identifiable information when you use our website to perform certain tasks as outlined below:

a. Contact information, feedback or correspondence to Vitruvy. For Users who contact Vitruvy through our website, certain contact information will be collected such as name and email address. Vitruvy may collect information such as your name, email address, health insurance information, gender, age, and symptom self-assessments when you fill out self-assessments and schedule consultations through Vitruvy’s website. Care Providers will receive scheduling requests, and the information provided in self-assessments only if a consultation is scheduled.

i. Self-Assessment Forms. When a user fills out a self-assessment or symptom tracking form using Vitruvy, we will collect information such as the User’s name, email address, phone number, gender, age and health insurance information when a member uses our site.  

ii.Scheduling. When a user fills out a self-assessment or symptom tracking form using Vitruvy and opts to schedule a consultation with a Care Provider, Vitruvy will send information to the Care Provider regarding the self-assessment form and scheduling information, such as the User’s name, email address, phone number, gender, age and health insurance information. Vitruvy shares User information only in the event that User schedules a consultation with a matched Care Provider. 

 iii. Contact Us. When a user fills out a “contact us” form through Vitruvy’s website, Vitruvy may collect information such as the user’s name and email address and will retain the information the User provides in the “contact us” form. Information submitted through the “contact us” form is kept by Vitruvy and is not shared with any third parties.  

 iv. Care Providers. Care Providers will have access to scheduling tools through the Vitruvy website, and will receive messages from Vitruvy regarding consultation scheduling, including user self-assessments/symptom tracking forms only in the event of a user scheduling a consultation. Care Providers will not have access to any user information unless a user specifically schedules a consultation with the Care Provider’s practice.  

 

b. Usage information about how you use our services and interact with us, including information associated with any content you submit to our site or information you otherwise provide when you use any interactive features of our services.

c. Other information that we may collect which is not specifically listed here, but which we will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection.

 

 

2. Automatic data collection. We and our Service Providers may automatically log information about you, your computer or mobile device, and your interaction over time with our services, our communications and other online services, such as:

 a. Device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 4G), and general location information such as city, state or geographic area. 

 b. Online activity data, such as the pages or screens you viewed, how long you spent on a page or screen, browsing history, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access, and whether you have opened our marketing emails or clicked links within them. 

We use the following tools for automatic data collection: 

 a. Cookies, which are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating online advertising. 

 b. Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications. 

 c. Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked. 

3. Information we obtain from third parties:

 a. Social media information. We may maintain pages on social media platforms, such as Facebook, LinkedIn, Instagram, YouTube and other third-party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use and processing of your personal information. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy. 

 b. Other Sources. We may obtain your personal information from other third parties, such as marketing partners, data providers, and publicly available sources such as governmental records.  

4. How we use your personal information 

 a. Vitruvy uses the information we collect to provide you with the services on our website that you request.  

 b. Vitruvy shares information with third parties only when needed to deliver you the products or services that you request. For example, when a User uses a self-assessment and choses to schedule a consultation with a matched Care Provider, the self-assessment and scheduling information is shared directly with the Care Provider. Vitruvy retains the information that Users provide in the event they schedule a consultation, but Vitruvy does not share or sell any personally identifiable information about Site visitors.   

 c. Vitruvy Care Providers are all HIPAA compliant and any communications between Vitruvy and Care Providers is protected by relevant privacy laws. Care Providers are subject to Business Associate Agreements pursuant to HIPAA law. Vitruvy blocks any Private Health Information from being shared with social media sites such as Meta or search engines such as Google pursuant to HIPAA laws.  

 d. To comply with law. As we believe necessary or appropriate to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities such as in the event of an audit.  

 e. For compliance, fraud prevention, and safety to: (a) protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); (b) enforce the terms and conditions that govern our services; and (c) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity. 

5. How we share your personal information 

 a. Vitruvy. When Users opt to schedule consultations with a Care Provider through Vitruvy, their self-assessment and scheduling information will be shared directly from Vitruvy to the Care Provider.  

 b. Reviews. We may collect User information through third-party review sites, such as Google or Facebook Reviews, and publish these reviews to our website or social media sites. 

 c. Vitruvy Service Providers. We may share personal information among our affiliates or with third-party companies that provide services on our behalf or help us operate our services (such as customer support, hosting, analytics, email delivery, marketing, identity verification, billing, accreditation document processing and database management services).  

 d. For Compliance, fraud prevention, and safety. We may share your personal information for compliance, fraud prevention and safety purposes described above. 

6. Your choices. Users who elect to schedule a consultation through Vitruvy agree to receive electronic communications from Vitruvy, and electronic and phone communications from Care Providers. 

7. Other sites, mobile applications and services. Our Site may contain links to other websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or in mobile applications or online services that are not associated with us. We do not control third-party websites, mobile applications or online services, and we are not responsible for their actions. Other websites and services follow different rules regarding the collection, use and sharing of your personal information. We encourage you to read the privacy policies of the other websites and mobile applications and online services you use.

8. Retention and Security practices. We will retain your Personal Information for a period of five (5) years, after which Personal Information will be deleted.  

Vitruvy follows generally accepted standards to protect personal information of our users. When you enter sensitive information such as symptom management or tracking forms, or inquiry forms we encrypt the transmission of that information. No method of transmission or storage electronically is one hundred percent (100%) secure, therefore Vitruvy cannot guarantee its absolute security.  

9. Changes to this Privacy Policy. We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy.

Additional information for users located in California, Nevada, and Vermont 

We are required by the California Consumer Privacy Act of 2018 (“CCPA”) to provide this CCPA notice (“CCPA Notice”) to California residents to explain how we collect, use, and share their personal information, and the rights and choices we offer California residents regarding our handling of their personal information. 

CCPA scope and exclusions 

This CCPA Notice and the CCPA privacy rights apply to California residents in the following circumstances: 

  • Individuals who visit our websites; 
  • Individuals who sign up for email alerts; or 
  • Representatives of businesses that seek to obtain our products or services, or to provide products or services to us. 

This CCPA Notice does not apply to the personal information we collect, use, or disclose about consumers who initiate or complete the process of applying for financial products or services for personal, family, or household purposes. This is because that information is subject to the federal Gramm-Leach-Bliley Act and implementing regulations, or the California Financial Information Privacy Act (for additional information relating to your choices about this information specifically, see our GLBA Privacy Notice). 

Your California privacy rights 

The CCPA grants individuals the following rights: 

  • Information. You can request information about how we have collected and used your Personal Information during the past twelve (12) months. We have made this information available to California residents without having to request it by including it in this Privacy Policy. 
  • Access. You can request a copy of the Personal Information that we have collected about you during the past twelve (12) months. 
  • Correction. You can ask us to correct personal information that is inaccurate or out of date. 
  • Deletion. You can ask us to delete the Personal Information that we have collected from you. 
  • Opt out of sharing personal information for targeted advertising. We share personal information with advertising partners that display targeted advertisements to users around the web. You can limit online tracking by clicking Online Tracking Opt Out on the footer of our website or contacting us as described below. We do not sell personal information. 

You are entitled to exercise the rights described above free from discrimination. 

Please note that the CCPA limits these rights by, for example, prohibiting us from providing certain sensitive information in response to an access request and limiting the circumstances in which we must comply with a deletion request. If we deny your request, we will communicate our decision to you. 

How California residents can exercise their rights: 

You may exercise your California privacy rights described above by emailing connect@vitruvy.com.  We will need to confirm your identity and California residency to process your requests to exercise your access, correction, or deletion rights. We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it. 

California residents can empower an “authorized agent” to submit requests on their behalf. We will require the authorized agent to have a written authorization confirming that authority. 

Other important information

California: If you are a consumer with a California mailing address, we will not share information we collect about you with companies outside of Vitruvy, unless the law allows. For example, we may share information with your consent, to service your accounts, or to provide rewards or benefits to which you are entitled. 

Nevada: If you are consumer with a Nevada mailing address, and you prefer not to receive marketing calls from us, you may be placed on our internal Do Not Call List by contacting us at connect@vitruvy.com. Vermont: If you are consumer with a Vermont mailing address, we will not share information we collect about you with companies outside of Vitruvy, unless the law allows. For example, we may share information with your consent, to service your accounts or under joint marketing agreements with other financial institutions with which we have joint marketing agreements. We will not share information about your creditworthiness within our corporate family except with your consent, but we may share information about our transactions or experiences with you within our corporate family without your consent.
